Probate records consist mainly of estate cases and guardianship cases. Sometimes other kinds of cases also came under the jursidiction of probate, such as adoptions and dissolving of business partnerships. The Hendricks County Clerk's Microfilm Department can help you find more information on a particular probate case. They are located on the second floor of the Hendricks County courthouse and can be reached by phone at (317) 745-9800.

ESTATE CASES

An estate case is usually about dividing the assets of someone who died, although sometimes it may be for someone who has been declared "absentee" from their residence for a number of years.

Estate Cases Filed in Danville Newspapers (1945-1976) updated25 September 2016
A searchable index to the estate cases that had legal notices published in the Danville newspapers Danville Gazette and The Republican for the years 1945 through 1976. This may not be a comprehensive list of all the Hendricks County estate cases for this period; legal notices could be filed in any newspaper in the county. More years will be added later.


WILL RECORDS

Sometimes before someone died, they signed a will specifying how they would like their assets to be divided. If a person left a will, the estate case for that person will usually be brief - just a notation of how the executor carried out the terms of the will. A will book contains a clerk's transcription of the will; the original, signed will is usually found in the probate packet.

GUARDIANSHIP CASES

A guardianship case is when someone is appointed as guardian of a "ward". The ward may be a child who inherited some assets, or an adult who needs to have their own assets taken care of.

An index to a Hendricks County Guardianship Bonds book which dates from 12 September 1904 through 25 April 1921. Entries in the bonds book are brief and include the date the guardianship bond was issued, the names of the sureties on the bond, and the names of the wards who were in the guardian's care. This index contains the name of the ward, as well as the name of their guardian, and the date that the bond was issued in the case.

PROBATE PACKETS

A probate packet is also known as "loose papers" or "case files". It contains all the original documents of the case (such as handwritten receipts and reports). The documents may have been folded and kept together with string or a rubber band. If these packets have survived at all, they may be in a fragile condition and may be stored offsite.

PROBATE ORDER BOOKS

A probate order book contains a brief summary (usually just 2-3 sentences) about what happened each time a probate case came before a judge. A probate case may span several order books.

PROBATE DOCKET & FEE BOOKS

A probate docket book recorded the name of the probate case and the name of the official (administrator, executor or guardian), as well as the date it was added to the court's calendar (aka docket). A probate fee book recorded the name of the probate case and the date that the court's fees for filing were paid.

PROBATE COMPLETE BOOKS

A probate complete record book contains an extensive summary of a probate case from its beginning to its end, as well as transcriptions of major documents (such as inventories and sale bills). Making a complete record of a probate case was not a requirement - it required the lawyer to pay an additional fee to the clerk - so most probate cases are not included in these books. The option of having a complete record made of a probate case was removed by the end of the 1800's.
